A Belgian judicial institution made a decision on Thursday not to accept a lawsuit filed by several Falun Gong practitioners against the former Chinese president Jiang Zemin, on charges of crimes against humanity, genocide, and persecution.

A spokesman for the Belgian Federal Court said, "The facts presented by the plaintiffs, about being arrested and then beaten and persecuted by police satisfy the conditions of the new law regarding genocide, yet they are not sufficient conditions for crimes against humanity."

Falun Gong practitioners accused Jiang Zemin of initiating a series of activities since June 1999, aimed at eliminating Falun Gong. The Falun Gong practitioners who filed the lawsuit against Jiang Zemin in Belgium include one Belgian practitioner and five who are of Chinese origin, but live in Belgium, Australia, Ireland, and the United States.

Regarding the decision made by the Belgian judicial institution, our reporter interviewed a spokesman for the European Falun Gong Information Centre, Zhang Jianping. He said, "According to my understanding, the main reason from the federal court is that two major plaintiffs, the two Falun Gong practitioners living in Belgium, have not encountered crimes as serious as those Jiang Zemin has been accused of, namely crimes against humanity, genocide and torture. I want to make three points.

First of all, tens of millions of Falun Gong practitioners have suffered from various forms of persecution including murder, torture - both mental and physical - unreasonably long detention and forced brainwashing. Even their families and friends have endured pressure in their lives, schools, and work. Hundreds of millions of people have been affected. That is to say that crimes of genocide, torture, and crimes against humanity do exist and the scope is pretty large.

Secondly, the responsibility and role of the law is to maintain social equality and justice. It is certain that some people in the judicial community wanted to consult legislation. I think there are conflicts, contradictions and regrets. The reason is that the ultimate role of law is to maintain social justice.

Thirdly, based on the two points mentioned above, I think the Falun Gong practitioners in Belgium will request the related agencies to reconsider their decision based on actual situations in the country where they reside."
