(Clearwisdom.net) Faced with more than four years of Jiang's regime's savage and sinister persecution, Falun Gong practitioners have not resorted to violence or other retaliation for the way they have been mistreated. Instead, they persisted in clarifying the truth in a peaceful, rational and legal manner to expose the insidious, evil persecution.

Jiang's regime has blanketed China and the rest of the world with an immense number of lies. The lies, the deceit and misinformation have covered up the facts. As a result, huge numbers of people have been deceived. For example, many people don't understand why Falun Gong practitioners have to tap into the TV system to broadcast truth clarification videos. They don't realize it's legal. In fact, if we can analyze the situation, bearing in mind the unique circumstances in the total picture, it's not hard to see who is right and who is wrong.

The specific articles of a law have their range, their prerequisites and background for application. We also have to consider the complex elements that are involved in individual cases. If we base our conclusion on the law alone and not consider the context in which the aforementioned elements are involved, then we are likely to draw a wrong conclusion that seems right even in a simple case.

For example, if a victim of robbery practices self-defense and grabs the weapon from the robber, we say the victim is only defending himself, and he is not seizing another person's property by snatching the weapon of crime. However, if we separate the cause of the victim's action from the whole situation and only look at the fact that the victim fought back the robber for a moment, we would likely to see the victim is "attacking" the robber and depriving the robber of his private property, the weapon, and it would appear as if the victim is doing something illegal.

We all know that China currently is not a nation ruled by law. The law does not restrain those in power. Instead, they often interfere with justice by overriding the law. Therefore, when those in power interfere with the law and become the dominant element or even replace the law, the law degenerates into a tool to serve the ones in power. This is how unjust cases arise. These types of wrongs happen often in China, and many criminals in power are not only free from punishment by law; they even slander and accuse the victims and retaliate against them using their positions of power.

The constitution of China protects citizens' right to freedom of belief. Falun Gong teaches people to be good, according to the tenets of "Truth-Compassion-Tolerance." People did not violate any law by practicing Falun Gong. However, for his own self-interest, on July 20, 1999, Jiang Zemin violated the constitution and began to usurp China's resources and the government machinery to begin an earth-blanketing, violent persecution of Falun Gong. The nature of Jiang's persecution of Falun Gong is similar to the aforementioned thief in the criminal case who attacked the innocent victim. The only differences are - 1. The criminal Jiang Zemin has unprecedented and unparalleled power; 2. Jiang coerces all levels of government officials to be accomplices to this crime, and he misuses China's resources and the government (including the public security system, the legal system, the media, the diplomatic system, and various government agencies) as his tools to commit the crime; 3. Jiang Zemin's persecution of Falun Gong is long lasting; it is far-reaching and the number of victims is astounding.

If Jiang was a perpetrator with no power, it could be easy for people to understand that Falun Gong practitioners are being victimized, that they are being rational and law-abiding in their peaceful appeals. However, Jiang uses his power to trample the law, to create lies and rewrite or supercede the law. If we don't take into consideration that Jiang overruled the law with his dictatorial power to attack Falun Gong, then we cannot understand the true nature of anti-persecution activities by Falun Gong and legal issues that are involved.

As the violator, Jiang's regime had hogtied the Chinese government, the legal system, the judicial system and the public media to use as his private mouthpieces and his criminal weapons. Since government itself is the executor of law, when the government strikes innocent victims by abusing the law, it becomes a highly deceptive entity and leads people to side with the government. As victims, Falun Gong practitioners try to clarify the truth and appeal to the government. They also try to appeal to the legal system, the public prosecutor, the public security system, the media and the people, which in China are controlled by the perpetrators, Jiang and his regime. Falun Gong practitioners' are totally deprived of their legal rights. They have nowhere to turn to appeal and reason. What awaits them, should they appeal, is prison, labor camps, torture, home ransacking, abduction, brainwashing and even torture or death.

In order to justify the persecution against Falun Gong, in October 1999, perpetrator Jiang Zemin forced the National People's Congress to pass an obscurely worded law with the purpose of suppressing Falun Gong practitioners at will. That obscure law, therefore, became the tool that the perpetrator uses to brutalize his victims. In court, Jiang is the defendant and head criminal, but he is also playing the role of the judge, the prosecutor, the police, the medical examiner, and the witness, because he has tremendous power. He also prohibits any lawyer to defend Falun Gong practitioners. Therefore, the courts not only fail to uphold justice, they became a place where the perpetrator further persecutes the victims, and the Chinese legal system was thus completely destroyed.

Large numbers of Falun Gong practitioners have been abducted and illegally arrested. Some were directly detained and others were put through show trials with no lawyers to defend them. The practitioners are not allowed to file lawsuits. There are too many cases to mention in this regard.

Jiang Zemin's minions manipulate media and propaganda department employees' mindsets so that the media has also become a major weapon in this criminal activity. At the same time, Jiang's regime established a news and information blackout and doesn't allow the people to speak.

Looking at the whole persecution, Jiang Zemin is the true head criminal. Without the persecution, there would not be any truth clarification activities. Jiang's regime never followed the law in dealing with Falun Gong, it also forces the government, the legal system, the public media and other government-controlled organs to directly take part in the persecution of the innocent through the information blockade, and the deprivation of people's right to know the truth in order to deceive them.

When they cannot get any protection from the law and their lives and property are seriously threatened, as victims of criminal Jiang's abuse of power and trampling of the law, Falun Gong practitioners followed the constitution to appeal in order to peaceably resolve the issue and clarify the facts. Moreover, Jiang labels all acts of appeal and truth clarification activities, by which Falun Gong practitioners explain themselves, as "illegal," "obstructing application of law" and by using this excuse, he orders arrests, detention, torture and even murder of Falun Gong practitioners who appeal, and the practitioners' family and work unit are also implicated.

Looking in terms of self-defense, which is legal by law, the victim has the right to appeal to the government and clarify the facts to everyone in society. The purpose of Falun Gong practitioners' appeal is mainly to ask those who carry out the orders of the head criminal to stop persecuting and murdering innocent lives and restore Falun Gong's legal rights. Their rational and peaceful anti-persecution activities are completely reasonable and legal. When confronted with such unjust and diabolic persecution, Falun Gong practitioners are forced to clarify the truth using various peaceful and rational means including appeal, distributing flyers and tapping into the TV system. They do so in order to expose the brutality of Jiang's regime. This is completely rational and legal, it's not "disturbing social stability" or "political acts;" it's an act of great compassion and tolerance that follows Truth-Compassion-Tolerance.

Right now, many people do not have a good understanding of the legitimacy of Falun Gong practitioners' actions of tapping into the TV system. As the head criminal, Jiang Zemin uses the public media to create lies and spread slander at will. He deceives people, instigates hatred, deprives people of their right to know, brainwashes all people in the country, psychologically manipulates the people, and therefore disables people from analyzing and judging an issue in an independent, just and rational manner. TV is one of the main tools by which Jiang commits his crimes. Falun Gong practitioners are law-abiding citizens and they are not against the government. When their life and property are seriously threatened, they are forced to tap into the TV system to expose Jiang's lies and facts of the persecution. TV tapping is the same kind of issue as the victim in the aforementioned robbery seizing the weapon used by the thief victimizing him. If we ignore the circumstances, the motive and the initial cause of practitioners' TV tapping, we cannot accurately determine the legality of the action.

Confronted with the situation that Jiang had already brutalized innocent people and that countless innocent people face serious life threats, with no other way to speak or appeal, TV tapping is an effective way to protest the persecution and expose Jiang's lies. Just like a victim's self-defense, TV tapping is completely legal because it serves the purpose of self-defense, and its goal is to protest the evil persecution and expose lies, so it is really a legitimate act of justice. If we don't consider the unique circumstances, the motive and the initial cause of action, there is no meaning in discussing whether TV tapping is a violation of law. Concluding that "TV tapping is illegal" would be an irresponsible assumption. China's radio-television Management Policy and Radio-Television Utility Protection Policy are not applicable here, because Falun Gong practitioners tapped into the TV system under special circumstances. If one accuses Falun Gong of sabotaging public property by TV tapping, it's unreasonable and does not stand. This is using the same logic as accusing that the victim snatches the robber's knife to defend himself is "illegal.". If the knife the perpetrator uses to attack the victim happens to belong to the public property, and the victim snatches the knife, can we accuse that the victim is "sabotaging public property"?

Therefore, Jiang Zemin group's sentencing of 18 Dafa practitioners including Liang Zhenxing, Zhou Runjun, Zhao Jian, Liu Chengjun, Yun Qingbin who participated in the TV tapping incident on March 5, 2002 to heavy jail terms is completely wrong and does not stand legal ground. From a legal perspective, this is the perpetrator retaliating against the victim, and it is against the application of justice. Practitioner Liu Chengjun was tortured to the brink of death in prison. He has been transferred to the Public Security Hospital located in Jilin Province. He is unconscious and can neither eat nor drink. Yet Jiang's regime still ruthlessly persecutes him. The Nong'an County Police Department, where Liu Chengjun's household registration is located, is afraid of taking responsibilities for him and refuses to allow him to go on parole to receive medical treatment at another hospital.

On January 22, 2003, Falun Gong practitioner, U.S. citizen Charles Li was arrested upon arrival at the Guangzhou Airport in China. He is currently being detained at a prison in Nanjing City, Jiangsu Province. According to Charles Li's appeal statement, in October 2002, while he was doing business in China, he put together five sets of TV tapping equipment and intended to broadcast truth clarification videos in Yangzhou City but didn't get to do it. Charles Li was on Jiang regime's blacklist (his name was collected in the U.S.) for practicing Falun Gong, and he is one of the big targets of persecution. His attempt to broadcast Falun Gong truth clarification videos revealing how the Chinese government illegally banned and persecuted Falun Gong, is not an isolated incident. It is only one example of Falun Gong practitioners around the world who make an effort to fight the persecution and clarify the truth. The goal is to restore the Chinese people's right to know, to awaken them from the criminals' brainwashing and psychological manipulation, and to learn the truth. Therefore, Jiang's accusation "sabotaging broadcast and TV facilities" against Charles Li does not stand. Many people blindly agreed with Jiang group's accusation, which is the result of being deceived by Jiang group's lies and not knowing the cause and the truth of the matter.

The true function of law is to punish the evil and spread the good, uphold social justice and protect the innocent, suppress the evil and protect people's lives and property from being encroached upon. When other people are not greatly inconvenienced, the law also gives the green light to activities that save lives. For example, an ambulance with a critically injured patient inside can go through traffic lights without stopping, and other people would not complain that they were slightly inconvenienced by stopping on the side to yield the way. This is a display of humanity.

Jiang's regime is the true perpetrator. It murders innocent people who practice Falun Gong and causes tremendous damage to innocent people's life and property, bringing a tremendous disaster upon China. The minds of countless people in the world have been poisoned by Jiang's group's lies. Right now every minute, many innocent Falun Gong practitioners are facing threats to their lives. Falun Gong practitioners' truth clarification activities, which are peaceful and rational, are completely legal and reasonable. What is truly affecting and sabotaging Chinese national security and stability are Jiang's group's criminal activities of violence and persecution, which should be tried in a court of law.
