  • Canada: Falun Gong Practitioners' Lawsuit Against Jiang Makes Breakthrough Progress

    On July 17, 2006, the plaintiffs, who have filed a lawsuit against Jiang Zemin and four other Chinese Communist Party (CCP) officials for torture, requested the court be dispensed with service to the defendants of the statement of claim and other court materials. The Ontario Superior Court granted their request. Plaintiffs' attorney Kate Kempton said, "The victory clears the way for a default judgment on the civil lawsuit."

    The lawsuit accused that the five defendants including Jiang Zemin, Luo Gan, Li Lanqing, Liu Jing and Wang Maolin orchestrated together a systematic and brutal persecution of the six Canadian plaintiffs and hundreds of thousands of other Falun Gong practitioners in China. One of the plaintiffs, Professor Kunlun Zhang, was a Canadian citizen at the time of his detention and torture in China.

    The CCP authorities have refused to accept the documents that the plaintiffs delivered through normal legal procedure.

    Master Glustein of the Ontario Superior Court said in the five-page decision, "The plaintiffs have done everything in [their] power to effect service of the claim."

    He also stated that it is in the interests of justice that service be dispensed with so that the case may proceed. "The plaintiffs will not be able to pursue any of these claims (systematic persecution and violations of genocide, torture and crimes against humanity) unless the Court dispenses with service."

    Six plaintiffs were satisfied with the court's decision, and hoped that the court will continue upholding justice in the proceeding later. If the defendants do not respond to the suit, the trial will go by default.

    One of the plaintiffs He Lizhi was illegally detained for three years and six months by the CCP for practicing Falun Gong prior to his arrival in Canada in 2004. He expressed that the court's decision heartened him.

    On November 15, 2004, Canadian citizen Kunlun Zhang and five other Ontario residents filed a civil lawsuit with the Ontario Supreme Court against former Chinese leader Jiang Zemin and CCP high-ranking officials including Li Lanqing, Luo Gan, Liu Jing and Wang Maolin. These people are primarily responsible for the torture and persecution imposed upon the six plaintiffs and hundreds of thousands of other Falun Gong practitioners.

    This case is one of 54 civil and criminal legal proceedings in 33 countries, against Jiang and other officials. Falun Gong practitioners have won several default judgments around the world.



    Paris: CCP Minister of Public Security is Sued in France

    On July 21, 2006, the French Falun Dafa Association, on behalf of three Falun Gong practitioners as the plaintiffs, filed a complaint with the Tribunal de Grande Instance de Paris to sue Zhou Yongkang, the Chinese Communist Party's (CCP) Minister of Public Security and State Council Member of China, the former CCP General Secretary of Sichuan Province. The complaint alleges that Zhou Yongkang bears direct responsibility for the crimes of torture against Falun Gong practitioners in China. The Tribunal de Grande Instance de Paris received the three complaints.

    The three plaintiff are Falun Gong practitioners Ms. Ying Dai, living in Norway, and Mr. Heping Li and Ms. Zhengfang Mo, living in the UK.

    Ms. Dai was the wife of a multi-millionaire in Shenzhen City. Due to practicing Falun Gong, she was illegally sentenced to three years in a labor camp. After that, she was sentenced again for another two years in a labor camp. During the periods of serving the sentences from March 2000 to January 2003, and from March 2003 to October 2004, Ms. Dai experienced extremely severe persecution and was in danger of losing her life. The CCP regime had to release her early due to her precarious physical condition. Ms Dai had been deprived of personal freedom for nearly four and a half years. During these periods of incarceration, she was subjected to brutal tortures and she has lost sight in her left eye, while her right eye has only 0.1 vision left due to prolonged electric shocks to her temples. The forced-feeding Ms. Dai experienced resulted in blood-spurting out of her mouth and nose. Male and female police officers stripped her and twenty other female Falun Gong practitioners of their clothes. She also suffered other abuse including sleep deprivation and brainwashing, and was forced to do hard labor.

    Ms. Zhengfang Mo was arrested in Beijing in December 1999 due to appealing to the Beijing authorities for justice for Falun Gong. During the period of the illegal detention, she was beaten by the police from her hometown of Chengdu, Sichuan Province. At that time she was eight months pregnant.

    Mr. Heping Li, a graduate of Chongqing University, was imprisoned in Shiliping Forced Labor Camp in Zhenjiang Province from August 2001 to June 2003 because of practicing Falun Gong. He was subjected to tortures including sleep deprivation, injection with harmful drugs, threats and other abuse. Both his body and mind were very much damaged by the severe persecution.

    The defendant, Zhou Yongkang, was appointed as the CCP¡¦s general secretary of Sichuan Province from December 1999 to December 2002. During his tenure, Zhou actively ordered and directly participated in the persecution of Falun Gong and made

    Sichuan one of the provinces known for the most severe persecution of Falun Gong in China. He was noted for slandering Falun Gong on various significant occasions many times, and also rewarded and encouraged individuals and departments of the Sichuan police who actively carried out the persecution of Falun Gong. He even gave specific suggestions to some department to deploy persecution methods against Falun Gong. On August 27, 2001, while visiting the US, Zhou was sued for the crimes of torture and crimes against humanity. Zhou Yongkang was accused under the "Torture Victims Protection Act" and the "Alien Tort Claims Act." The indictment was filed by a thirty-six-year-old Boston resident, Mr. Haiying He.

    Although Zhou Yongkang did not have any work experience in the public security field, he closely followed Jiang Zeming¡¦s policy of persecuting Falun Gong. Therefore he was promoted to the post of Minister of Public Security of China in December 2002, and also appointed as the deputy-director of the Social Safety Comprehensive Administration Committee of the central government, and the deputy CCP General Secretary of the Political and Legal Committee of the central government. All of these titles give him full power to persecute Falun Gong.

    According to an investigation report into the 610 Office by the World Organization to Investigate the Persecution of Falun Gong, the 610 Office is subordinate to the Political and Legal Committee. The Political and Legal Committee has authority over the Public Security, the Judicature, Education and the Culture Departments.

    In December 2002, Zhou Yongkang took the post of Public Security Minister. At the beginning of his term, he continuously made speeches at nationwide videophone meetings to the police system and at conferences to high-level officials in the national police system, to drive the persecution of Falun Gong. He also made use of the opportunities of surveillance throughout the country to emphasize the "strict guarding" and "strict striking" against Falun Gong. Zhou Yongkang, using the title of Public Security Minister, also made recommendations and gave material rewards to those individuals and groups who were actively involved in the persecution of Falun Gong.

    In addition, under the excuse of carrying out "comprehensive maintenance of social public security," "striking the hostile influences inside and outside China," "anti-terrorism," and "maintaining stability," Zhou Yongkang many times coerced and made use of the police and judicial systems to conduct the persecution of Falun Gong, which resulted in the steady escalation of the persecution. Since December 2002, the numbers of confirmed and documented cases of Falun Gong practitioners being persecuted to death rapidly increased from over 600 to approximately 3,000.

    In summary, Zhou Yongkang is directly responsible for the crimes of the persecution of Falun Gong in Sichuan Province as well as nationwide, including the brutal persecution of the three plaintiffs.

    The French Falun Dafa Association informed the public media after handing in the complaints to the court. Agence France Presse (AFP) published a report immediately, and several important media reprinted or contacted Falun Gong practitioners to express their concern. The Chinese Department of Radio France International (RFI) promptly broadcast the story twice in their report to mainland China and the greater Paris area.
    The Falun Gong practitioners¡¦ lawsuit against Zhou Yongkang enormously frightened the evil regime and gives a warning to those people who are still persecuting Falun Gong: Stop doing evil and be responsible for your own futures.



    Japan: Falun Gong Practitioners Protest the CCP Atrocities of Live Organ Harvesting

    Falun Gong practitioners from across Japan gathered on July 30, 2006 in Nagoya to hold a rally and parade protesting the Chinese Communist Party (CCP) persecution. They also called for an end to the CCP's harvesting and trading organs from living Falun Gong practitioners, and putting an end to the CCP persecution of Falun Gong.

    Falun Gong practitioners used various means including an anti-torture exhibit, reenactment of the CCP live organ harvesting, and display boards to expose to passersby the CCP persecution of Falun Gong that has persisted for seven years, particularly its evil deeds recently exposed about harvesting organs from living Falun Gong practitioners for profit. They called on people to support a thorough investigation into this revelation, and support anti-persecution efforts.

    At the rally site, Falun Gong practitioners reenacted the CCP live organ harvesting, and torture methods used in forced labor camps by merciless guards to force Falun Gong practitioners to give up their beliefs. The torture methods they demonstrated included the tiger bench, beating while being hung up, hammering bamboo spikes into fingernails and being locked in small cell.

    Two practitioners took turns introducing through a megaphone what Falun Gong is, why the CCP persecutes Falun Gong and the CCP crimes recently exposed about systematic harvesting of organs from living Falun Gong practitioners for profit. They called for people's attention and help to stop the persecution.

    One of the two practitioners said, "Recently, a Canadian independent investigation team concluded that the allegations of the CCP harvesting organs from living Falun Gong practitioners and then illegally trading them are true. The Canadian government expressed taking action after learning about it. Japanese people should also take such brutality seriously, and voice concern to stop the persecution."

    Falun Gong practitioner Ms. Yoko Kaneko, who was once illegally detained for eighteen months by the CCP for distributing fliers exposing the CCP persecution of Falun Gong, said at the rally, "Around October 2002, I was illegally detained in Beijing Women's Forced Labor Camp. All Falun Gong practitioners illegally detained there were given a physical check-up. We all were very surprised at the time. I wondered that with the CCP persecution of Falun Gong policy being to 'destroy practitioners physically,' 'beating practitioners to death is counted as suicide,' how could it be concerned about Falun Gong practitioners' health? After the revelation of the CCP harvesting organs from living Falun Gong practitioners and illegally trading them, I eventually realized that its purpose was to establish an archive for organ transplants. If I was not rescued, I may have been one of the victims who have had their organs harvested while still alive."

    A representative of the Japanese Falun Dafa Association said to the reporter, "The purpose of today's activity is to end the CCP's persecution of Falun Gong as soon as possible. The CCP's acts of harvesting and trading organs from living Falun Gong practitioners are shocking and horrifying. Japan will also form a special investigation team to China, to conduct an independent investigation into the CCP's harvesting organs from living Falun Gong practitioners. Certainly, we also can assume that the CCP will hamper this action. There have been righteous people in Japan who want to participate in the special investigation team."

    He also said that the medical field in Japan, especially the organ transplant field, has learned about these crimes happening in China. We hope to stop the CCP's mass killing and soon release all illegally detained Falun Gong practitioners.

    In the afternoon, Falun Gong practitioners held a parade in downtown Nagoya. At the same time, they passed out fliers exposing the CCP systematic harvesting and trading organs from living Falun Gong practitioners.
